HACSU members make a stand against unfair treatment

We managed to get them to see reason

HACSU members at Caylea have stood up to Anglicare management, who were trying to ignore genuine concerns about a new roster that would have meant cuts to services for clients and endangered workers’ rights.

Management wanted to bully their way through with these changes despite breaches to your workplace agreement and concerns for clients’ welfare.

They were determined to push ahead, but we finally managed to get them to see reason just hours before they were scheduled to appear before the Fair Work Commission to have our dispute heard.

The good news is that we now have a proper consultation process which will mean Anglicare will have to listen to you.

Here’s what has been agreed:

• Anglicare will provide Caylea workers with details of their contracted hours in writing as of Thursday 22 December. If there is disagreement on this figure, then Anglicare will work constructively to resolve in the next 7 days.

• Caylea employees will work the “old” Caylea roster from 22 December 2022 until 4 January 2023. The old Caylea roster will be put into Skedulo now and should appear today – this will be the source of truth.

• The new Caylea roster as detailed by Anglicare (including the 8–11am shift) will commence on 5 January 2023.

• Anglicare will email Caylea staff on 22 December seeking feedback on their rosters relating to the community shifts, which were used to supplement their hours under the new Caylea roster to reach their full contracted hours.

  1. Staff will provide details/feedback on what of the proposed community shifts they are able to work.
  2. Anglicare will meet with staff individually to work through these community rosters over the next 14 days to have a roster that works for the employees and clients. Acknowledging that the community shifts to support clients are likely to be shorter in length and may require gaps in between, unlike some of the current arrangements with their Caylea shifts.
  3. Anglicare will facilitate appropriate buddy shifts and meet and greets with new clients as required.
  4. To work constructively to have these community shifts start as soon as possible and that commencement may be progressive as agreed between employee and employer

• Anglicare will pay workers all of their contracted whilst working through the details on appropriate community shifts.

• Anglicare will work with the Caylea staff to build an evidence base to put to MAIB to seek an extension of the 8–11 am shift until 1pm.

• HACSU will write to the FWC and seek a postponement on this afternoon’s hearing until at least 19 January (this is a fortnight after the new Caylea roster starts – Anglicare are confident all rosters can be resolved by this time).

We wrote to the Fair Work Commission as agreed and the Commission hearing has been delayed. We also understand workers have now received their contracted hours. We’ll monitor the process to ensure the above is implemented.
